1. About these terms

These terms govern access to and use of firstlookproperty.co.uk (the ‘Website’). By using the Website, you agree to these terms. If you do not agree, please do not use the Website.

The Website is owned and operated by Samantha Childs trading as FirstLook, an independent overseas property consultancy.

2. Website terms are not client terms

These terms apply to browsing and using the Website. They do not form the contract for a FirstLook Report, FirstLook Plus, FirstLook Visit, FirstLook Select, FirstLook Advocate or any other paid or commissioned service.

A service will only be provided after its scope, price and applicable Client Terms and Conditions have been agreed. Sending an enquiry, booking an introductory call or describing a property does not oblige you to purchase a service and does not oblige FirstLook to accept an instruction.

3. About the Website

The Website provides information about FirstLook, overseas property-purchase considerations, available or planned services, locations and editorial features. Website content is provided for general information and to help prospective clients understand the nature of FirstLook’s work.

References to services marked ‘coming soon’, descriptions of possible services or examples of what a service may include do not guarantee current availability or that a service will be suitable for a particular property or country.

4. Important professional boundaries

Unless expressly agreed otherwise in writing, Website content and FirstLook’s general communications do not constitute:

  • legal advice, conveyancing or representation by a lawyer;
  • a building survey, structural survey or regulated property inspection;
  • a valuation or mortgage valuation;
  • financial, mortgage, investment, tax or insurance advice;
  • architectural, engineering or technical certification; or
  • a guarantee that a property is legally compliant, defect-free, suitable, saleable or a sound investment.

Appropriate independent lawyers, surveyors, tax advisers, financial advisers, architects, engineers or other regulated professionals should be instructed where their expertise is required. FirstLook does not make a purchasing decision on your behalf.

5. Accuracy and local change

We take reasonable care when preparing Website content, but overseas property rules, planning information, taxes, procedures, prices, services and local conditions can change. Content may become incomplete or out of date and may not apply to every property, municipality, autonomous community or country.

You should not rely solely on general Website content when making a financial, legal or property decision. Information material to a proposed purchase should be checked against current official sources and confirmed by an appropriately qualified professional where necessary.

6. Editorial features and opinions

Articles and FirstLook Stories may discuss property, practical life overseas, culture, public services, consumer issues and other topics from an independent editorial perspective. They may contain observations, commentary or opinion as well as factual information. They are not personalised recommendations and do not create a consultant-client relationship.

7. External websites and services

The Website may link to external websites or services, including public authorities, property portals, Calendly and social-media platforms. Links are provided for convenience or context and do not amount to endorsement, approval or a guarantee of accuracy.

We do not control external websites and are not responsible for their availability, content, security, privacy practices or terms. You should review their policies before using them or providing personal information.

8. Intellectual property

Unless otherwise stated, the Website and its original content, structure, wording, branding, graphics and materials are owned by or licensed to Samantha Childs trading as FirstLook and are protected by intellectual-property law.

FirstLook, FirstLook Report, FirstLook Plus, FirstLook Visit, FirstLook Select and FirstLook Advocate, together with associated names, logos and presentation, may be used as FirstLook trading names, brands or marks. Nothing in these terms grants a licence to use them.

You may view the Website and print or download a reasonable extract for your personal, non-commercial consideration of FirstLook or an overseas property purchase. You must not, without prior written permission:

  • copy, reproduce or republish substantial Website content;
  • sell, license or commercially exploit Website material;
  • remove authorship, copyright or trade-mark notices;
  • present FirstLook content as your own or use it to create a competing report or service; or
  • use automated tools to scrape, harvest or systematically extract Website content or data.

Short quotations for genuine review, reporting or other use permitted by law are unaffected, provided appropriate acknowledgement is given.

9. Acceptable use

You must not:

  • use the Website unlawfully, fraudulently or to harm another person;
  • attempt to gain unauthorised access to the Website, hosting, accounts or data;
  • introduce malware, malicious code or excessive automated requests;
  • interfere with the Website’s operation, security or availability;
  • submit false, misleading, abusive, infringing or unlawful material through the enquiry form; or
  • use contact details published on the Website to send spam or unsolicited bulk marketing.

10. Website availability

We may change, suspend, withdraw or restrict any part of the Website without notice, including for maintenance, security, legal or business reasons. We do not promise that the Website will always be available, uninterrupted, error-free or free from harmful code. You are responsible for using suitable device security and maintaining your own backups.

11. Liability

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or rights that cannot lawfully be excluded under consumer law.

Subject to that qualification, FirstLook is not responsible for loss caused by reliance on general Website content instead of obtaining property-specific checks or appropriate professional advice; for changes in external information after publication; or for the acts, omissions, content or availability of third-party websites and services.

If you use the Website for business purposes, FirstLook will not be liable for loss of profit, revenue, business, opportunity, anticipated savings, goodwill or any indirect or consequential loss arising from use of, or inability to use, the Website. Separate liability provisions will apply to any commissioned FirstLook service under the applicable Client Terms and Conditions.

12. Privacy and cookies

Our Privacy Notice explains how we use personal data. Our Cookie Policy explains the Website’s current use of cookies and similar technologies. Both form part of the information governing use of the Website.

13. Linking to the Website

You may link fairly and lawfully to the Website’s public pages, provided the link does not damage our reputation, imply an association or endorsement that does not exist, or frame the Website within another site. We may ask for a link to be removed where it is misleading, unlawful or harmful.

14. Changes to these terms

We may update these terms to reflect changes to the Website, FirstLook’s services or applicable law. The current version will be published on the Website with its effective date. Continued use after an update means the revised terms apply to that use.

15. Governing law

These Website Terms of Use and any non-contractual dispute relating to the Website are governed by the law of England and Wales.

The courts of England and Wales will have jurisdiction, except that if you are a consumer living elsewhere you retain any mandatory rights to bring proceedings in the courts available to you under applicable consumer law. Nothing in these terms removes mandatory rights under the law of the country in which you live.
